Review: Easy process to book a scooter and at a reasonable price. The women who rented us the scooter was very keen to try and extract money from us any way she could though, which was a shame. Just make sure you take photos of all scuffs and return before the time you picked it up.

Review: IT IS ILLEGAL FOR THEM TO KEEP YOUR PASSPORT !!!
The law stipulates that they can only hold a copy of it as collateral.
In Thailand, the relevant legal framework for handling passports and rental agreements is rooted in a combination of immigration law and tourism regulations.
1. Immigration Law (Section 33 of the Immigration Act)
The Immigration Act of 1979, specifically Section 33, mandates that foreign nationals must carry their passport or a copy of it when traveling within Thailand. However, it does not grant businesses the right to hold onto a passport as a form of collateral or security for services like car or motorbike rentals.
2. Tourism Business and Guide Act (2008)
According to the Tourism Business and Guide Act of 2008, tourism-related businesses (including rental companies) are not allowed to retain a foreign national's passport. While this act doesn’t explicitly address passport retention by rental agencies, it does align with the broader rules governing the treatment of foreign visitors. Rental agencies are generally required to handle guests' documents with due care and respect.
3. Consumer Protection Laws
In Thailand, the Consumer Protection Act also protects consumers from unfair business practices. It would be considered unfair and illegal for a car or motorbike rental company to confiscate or permanently hold onto a passport. Any business that asks for a passport as collateral is supposed to return it immediately once the transaction is completed.
4. Tourism Police Regulations
The Tourism Police in Thailand often intervenes in cases where tourists report scams, including passport retention. If you find yourself in a situation where your passport is being held without reasonable grounds, you can report it to the Tourism Police, who can help you recover your passport and possibly take action against the business.
What You Should Do:
- If a rental agency demands to keep your passport, politely request that they take a copy instead.
- If they refuse, consider finding an alternative rental company.
- Report the incident to the Tourism Police if you feel your rights are being violated.
In practice, you will typically find that most reputable rental agencies will only ask to take a photocopy or scan of your passport for security purposes and will return your original document to you immediately.
If you ever face issues with this in Thailand, I recommend contacting the Tourism Police directly or visiting a local Embassy or Consulate for further assistance.
